Intellectual Property Rights Statement

Prestige Computers – Victoria, Australia

All content, designs, custom builds, branding, logos, product imagery, and related media produced or displayed by Prestige Computers are protected under Australian Intellectual Property Law, including the Copyright Act 1968 (Cth) and the Designs Act 2003 (Cth).

Unless otherwise stated:

- (including PC case designs, mods, branding, and promotional materials) remain the exclusive intellectual property of Prestige Computers.

- remain the property of the customer upon full payment, but the design and build process, schematics, and aesthetic concepts remain the intellectual property of Prestige Computers and may not be reproduced, copied, or distributed without written consent.

- (including social media content and marketing materials) is not permitted without our express written permission.

- collaborative projects involving third parties (e.g. artists, modders, creators) will have shared IP arrangements as agreed upon in writing before project commencement.

- We take pride in original craftsmanship and creative design — and we are committed to protecting the work of our team and our partners.

Payment Policy

You can pay via Direct Deposit, PayID, or Credit Card via the details sent to your email.

When ordering through Shopify you have the same options.

Full payment is due and or needs to be cleared into our bank account before in stock systems can be picked up, or sent via courier.

For all pre-orders we require full payment before we can proceed to ordering stock, we will keep in contact with you on parts availability and system build lead times.

Returns, Refunds & Warranty Terms & Conditions

Warranty Returns

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the products repaired or replaced if the goods fail to meet acceptable quality and the failure does not amount to a major failure.

You can find more information about the Australian Consumer Law on the ACCC website: www.accc.gov.au (see under the "For Consumers" tab). Prestige Computers offers this warranty in
conjunction with any guarantees imposed by the Australian Consumer Law.

The following factors will be considered
when determining whether a problem is major:

- The type of product.

- How much time has passed since the product was purchased.

- How a consumer is likely to use the product and its intended purpose.

- The length of time for which it is reasonable for the product to be used.

- The amount of use it could reasonably be expected to tolerate before the failure.

- Whether repair or service parts are available for refurbishment.

- The time required for repair or refurbishment, and whether this is reasonable.

Once Prestige Computers has tested the product(s):

- If the fault is determined as a major failure, the customer can choose either:

- A refund based on the original invoice amount.

- A like-for-like replacement of similar specifications, capabilities, and performance, if reasonably available.

- If the fault is minor, we may offer:

- A repair of the original goods.

- A refurbished replacement.

- A like-for-like brand new replacement of similar specifications, capabilities, and performance, if reasonably available.

- A pro-rata refund reflecting the current
value of the returned goods, based on reasonable expected lifetime and prior
use.

Warranty Shipping Requirements

- Unless explicitly stated, all warranties provided by Prestige Computers are return-to-base. Customers can return goods in person for assessment, or via post to our designated service department.

- For goods returned via post, a Return Authorisation (RA) application must be completed beforehand, and approval issued by Prestige Computers.

- Goods must be returned to the address provided with the RA.

- RA numbers can be issued online after completing a return application, or provided by a support team member by phone or email.

- If website access is not available, customers may contact our after-sales support team via online support query, email or by calling 0402 457 676.

- Prestige Computers accepts no responsibility for goods returned without prior acknowledgement. The RA number is the only way we can identify returned goods. Failure to include an RA number
may result in mis-delivery, misplacement, or loss outside our control.

- Prestige Computers will cover logistics costs for valid warranty claims on items originally shipped to you. For in-person purchases, customers returning items via post are responsible for
logistics costs. Customers may also return goods to any open branch during business hours at no cost.

- While original packaging is not required, we recommend using it where possible. The packaging you received is specifically designed to carry your goods safely. If unavailable, please use
adequate safe packaging. Damage caused by poor packaging will not be covered under warranty.

- Prestige Computers provides warranty solely on products sold by Prestige Computers. Products purchased elsewhere, even if used in conjunction, are not covered.

- All items sold by Prestige Computers include proof of purchase and a serial number. Altering or removing serial numbers may prevent us from processing your warranty.

- Components must be professionally installed in accordance with the documentation. Issues caused by improper installation are not covered. Prestige Computers offers professional
installation services to avoid such issues.

- For products with data storage (e.g., desktops, servers, NAS, internal/external storage), data loss is not covered. Customers are responsible for backing up personal data. Recovery Services are done offsite and will occur additional third party fees.

- User data is only stored by Prestige Computers during warranty processing. Faulty storage devices are returned to the manufacturer’s authorised repair centre and handled under their data
policies.

- Warranty is void if items show evidence of mishandling, modification, physical damage, abuse, liquid damage, corrosion, overclocking, or other improper use.

- Normal wear and tear (e.g., keyboards, mice, consumables) is not covered if caused by abnormal or extreme use.

- If returned items are found to be fault-free, a service fee of $88 (inc GST) per product may apply, along with shipping and handling costs. Customers are encouraged to contact support for
troubleshooting before returning products.

- If delivered goods do not match your invoice, notify us immediately. Do not open retail packaging or use the products, as this will be deemed acceptance of goods.

- Prestige Computers retains ownership of any incorrectly shipped goods. We will arrange collection and cover associated costs.

- Uncollected warranty items will be held for 90 days, after which they may be disposed of under the Australian Consumer Law’s uncollected goods policy.

System Warranties

- Prestige Computers systems and custom builds include a serial sticker for quality control and warranty purposes. Do not remove this serial.

- Customers are encouraged to verify system components upon receipt and report inconsistencies immediately.

- Missing, incomplete, physically damaged, or incorrectly installed hardware will be assessed reasonably. Manufacturer faults remain covered.

- Systems are built using standard off-the-shelf components for performance and value. Users may modify systems without voiding warranty, but any resulting issues are the customer’s responsibility. Troubleshooting costs may apply.

- All Prestige Computers systems come with a 3-year warranty covering repair and maintenance of the original configuration. Hardware or software outside the original configuration is excluded.

- Warranty does not cover software issues (e.g., drivers, updates, malware). Standard troubleshooting charges apply.

- Some repairs may require resetting or reformatting drives. Prestige Computers is not responsible for any resulting data loss. Customers must maintain backups.

Non-Faulty / Change of Mind Returns

Prestige Computers may accept returns for non-faulty goods if all the following criteria are met:

- The product has not been opened, and all packaging seals are intact.

- The product is regularly stocked by Prestige Computers and was not custom-ordered.

- The product is not in large quantities (more than 3 units).

- The product is returned within 30 days of delivery.

- The product has not been modified or customised.

Prestige Computers may, at its discretion, accept non-faulty returns outside these criteria. Such returns may incur a restocking fee of up to 10%.

Additional notes

- All change-of-mind returns are subject to inspection and approval.

- Refunds will be based on the lower of
either the original purchase price or current retail price.

- Returned products must be in a condition suitable for resale.

- Items that are dropped, damaged,
modified, tampered with, or missing manufacturer labels will not be accepted.

- Goods that have been opened are subject to testing and may take additional processing time.

- Some product categories are excluded from non-faulty returns, including:

- Software licenses or digital items.

- Products that interface with the body
(e.g., eyewear, headsets, headphones).

- Consumables with a shelf life (e.g., liquids).

Price Protection

The prices of consumer electronics can fluctuate daily. Prestige Computers does not offer price protection and will not issue refunds or credits for price drops after purchase. By making payment, you
agree to the price at the time of purchase.

Limit of Responsibility

To the extent permitted by law, Prestige Computers shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from:

- The use or misuse of products or services supplied

- Hardware or software failures caused by third-party components

- Loss of data, productivity, or business interruption

- User-applied modifications, overclocking, or non-standard configurations

- Issues resulting from environmental conditions (e.g. dust, moisture, power surges, improper ventilation).

Our responsibilities are limited to those outlined by Australian Consumer Law (ACL). Where applicable, you are entitled to a replacement, repair, or refund if a product fails to meet acceptable quality standards.

We do not warrant:

- Compatibility with third-party hardware or software not supplied by Prestige Computers

- Performance beyond intended usage parameters (e.g. overclocking beyond factory-safe levels)

- Customer-installed alterations or physical damage caused post-sale.

All services and systems are provided as is” unless otherwise stated in a signed service agreement or warranty document. Prestige Computers reserves the right to determine warranty applicability and repair/replacement options in line with the ACL.

Customer Data Policy

At Prestige Computers, we respect the privacy and importance of our customers’ data. However, it is the customer’s responsibility to ensure that all personal, business, or sensitive data added to the system after purchase is properly backed up and secured — ideally stored separately from the computer itself.

This is essential to protect against potential data loss due to drive failure, corruption, or other events beyond our control, and must be done prior to any service, repair, upgrade, or diagnostic work.

Limit of Responsibility

While our technicians handle every system with care and professionalism, Prestige Computers accepts no responsibility or liability for any loss, corruption, or inaccessibility of data that may occur during:

- Hardware or component replacement

- Software reinstallation or system formatting

- Malware removal or recovery

- Upgrades, overhauls, or diagnostic procedures

- Any other service conducted on a customer-provided device

Issues caused by normal computer usage, including:

- Normal Wear-and-tear on components over time

- User-installed software or third-party drivers

- Operating system corruption from improper shutdowns, viruses, or incompatible updates

- Environmental factors such as power surges, overheating, or physical damage


Customer Acknowledgement


Before any service is performed, customers will be asked to complete a service form acknowledging the following:

- Data protection is the customer's responsibility. Prestige Computers is not liable for any data loss, corruption, or inaccessibility unless caused by proven negligence.

- Data backup, access, or recovery will not be performed unless explicitly requested and agreed upon in advance.

- Data services, if requested, are subject to additional charges and are provided on a best-effort basis with no guarantee of recovery.


Optional Data Services

Prestige Computers offers optional professional data services, including:

- Full system backups prior to work

- Data migration to a new drive or system

- Recovery attempts on damaged or corrupted drives

These services are quoted separately and may require additional time depending on the size and condition of the drive.

Indemnity Policy

1. Purpose

This Indemnity Policy outlines the extent of liability accepted by Prestige Computers and defines the customer’s responsibilities in relation to the use, servicing, modification, and interaction with products, services, and our digital platforms.


2. General Indemnity


By engaging Prestige Computers for any service, purchase, repair, upgrade, custom build, or by using our website or visiting us at any event (including but not limited to Supanova, PAX, trade shows, and community expos), the customer agrees to indemnify and hold harmless Prestige Computers, its employees, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses, including legal fees, arising out of or in connection with:

- Misuse, neglect, improper installation or handling of hardware after collection or delivery or during event demonstrations.

- Software issues, third-party integrations, or user-induced faults after a system has been commissioned or serviced

- Data loss, corruption, or security breaches not resulting from demonstrable negligence on the part of Prestige Computers

- Environmental factors including, but not limited to, power surges, overheating, liquid damage, or pest intrusion

- Environmental damage, including but not limited to overheating, power surges, spills, or accidental impact at or after public demonstrations

- Any interaction with Prestige Computers’ equipment or displays at public events, including user-operated stations, terminals, or demo rigs

- Use or misuse of our website, services, or marketing materials, including purchases made from event-exclusive offers

- Use of third-party components or accessories not recommended or installed by Prestige Computers

- Use or misuse of the Prestige Computers website, including:

- Downloading of files, drivers, or software

- Submission of forms or personal data

- Misinterpretation of product specifications, pricing, or availability

- Loss of data or damage to hardware resulting from instructions, downloads, or suggestions found on the site


3. Event-Specific Participation


When attending public events (e.g. Supanova, PAX, tech expos, conventions), all attendees engaging with Prestige Computers’ setups, display hardware, or interactive components acknowledge that:

- Participation is at their own risk

- Prestige Computers is not liable for injuries, data loss, or hardware issues resulting from improper use of demo units

- Demo or prototype systems may not reflect final product functionality, and issues experienced on-site do not reflect warranty conditions unless otherwise stated

- All photos, video, and promotional material captured at events may be used by Prestige Computers for marketing and archival purposes unless a written request for exclusion is submitted


4. Limitations of Liability

- Prestige Computers shall not be liable for incidental or consequential damages, including but not limited to business interruption, loss of profits, or loss of data, except where required by Australian Consumer Law.

- Our maximum liability for any claim arising under this agreement shall not exceed the amount paid by the customer for the specific service or product directly related to the claim.

- Any warranty, service, or support claims will be limited to the original purchaser and may be void if equipment is altered or tampered with post-sale.


5. Customer Responsibilities

Customers are solely responsible for:

- Maintaining secure and up-to-date backups of their data before submitting any system for service or diagnostics

- Notifying Prestige Computers of any sensitive, proprietary, or licensed software present on the device

- Reading and understanding the relevant service agreement or policy prior to work being undertaken

- Ensuring personal systems meet technical requirements when acting on website advice, downloads, or purchase decisions

- Advising us of any known existing faults, modifications, or special handling requirements before submission


6. Website Disclaimer

While Prestige Computers takes all reasonable steps to ensure the accuracy, security, and availability of its website, we make no guarantees that our website will be free from interruptions, errors, vulnerabilities, or viruses. Users access our website and digital content at their own risk.


7. Acceptance of Terms

By engaging our services, submitting a device for service, purchasing products, or using our website, the customer confirms acceptance of this Indemnity Policy in full. A signed service form, online order confirmation, or website use constitutes acknowledgement and agreement to this policy.

This policy shall be governed by, and construed in accordance with, the laws of the State of Victoria and the Commonwealth of Australia.

Any disputes arising under or in connection with this policy, or the services provided by Prestige Computers, shall be subject to the exclusive jurisdiction of the courts of Victoria.

By engaging with our services, website, or purchasing products, you agree to submit to the governing laws and legal processes of Victoria, Australia.
